AIRosense is committed to providing quality service while maintaining fairness and transparency in handling unforeseen challenges.
1. General Agreement
By paying the deposit, the Client agrees to these terms and conditions.
2. Deposit and Payment
- A deposit of 80% is required for all new installations when AIRosense supplies the air conditioning units. This deposit secures stock, materials, and installation dates.
- The remaining balance must be paid within 3 days of job completion.
- If the balance remains unpaid for 30 days, AIRosense retains the right to initiate legal action to recover costs.
- Until full payment is received, AIRosense retains ownership of all installed equipment.
3. Changes to Job Scope
- Changes initiated by the Client during installation, such as relocating indoor or outdoor units, may require additional time and materials. These changes may result in added costs, which the Client agrees to cover.
- If unforeseen challenges arise (e.g., limited access, unexpected structural issues), AIRosense will strive to communicate these costs during the installation. However, Clients acknowledge that some costs may be billed after job completion.
- If additional work has been physically installed or completed on-site and is visually visible, the Client agrees to pay for these additional costs.
4. Open Approach to Additional Costs
- AIRosense values transparency and will document all additional costs incurred due to unforeseen challenges or Client-initiated changes.
- Clients are encouraged to discuss their concerns with AIRosense promptly if there are queries about the final invoice.
- Both parties agree to work in good faith to resolve any discrepancies regarding additional costs fairly and reasonably.
5. Installation Challenges and Delays
Installation dates are subject to change due to circumstances beyond AIRosense’s control, including:
- Adverse weather conditions.
- Delays in equipment or material delivery.
- Access restrictions at the Client’s property.
AIRosense will notify the Client as soon as possible if delays are anticipated.
6. Use of Existing Infrastructure
- AIRosense provides quotations based on either new installations or the re-use of existing ducting, electrical supply, and related infrastructure.
- Where the client elects to retain and reuse existing infrastructure, AIRosense shall not be liable for:
- Any inefficiencies, airflow issues, or cooling discrepancies arising from pre-existing ducting.
- Structural integrity or defects within existing ducting, electrical supply, or previous installations.
- Any additional work required to rectify inefficiencies related to the pre-existing infrastructure, unless separately quoted and paid for.
7. Performance & Rectifications
- AIRosense guarantees the installation of new equipment only.
- Performance issues arising from external factors, such as outdated ducting or insufficient electrical capacity, do not constitute a defect in AIRosense’s workmanship.
- If post-installation performance issues are directly attributed to the client’s existing infrastructure, AIRosense reserves the right to charge for additional labor and materials required for any rectifications.
- Clients are advised that ducting integrity, efficiency, and compatibility remain their responsibility if reusing existing infrastructure.
8. Electrical Work
- Standard electrical pricing is based on the agreed job scope during the quotation stage.
- If additional electrical work is required due to unforeseen site conditions (e.g., longer wiring runs, additional breakers), the Client is responsible for these costs.
- If the Client opts to use an existing power source, AIRosense shall not be liable for tripping, breaker faults, or inadequate electrical capacity.
- Any additional electrical work required due to site conditions will be billed separately, and AIRosense will not proceed until the client has accepted such additional costs in writing.
9. Common Additional Costs
Examples of common additional costs include:
- Extra copper piping or electrical wiring beyond what was quoted.
- Access equipment (e.g., ladders or scaffolding) for ceiling voids or restricted spaces.
- Changes to agreed unit placements requiring relocation or modifications.
- Upgrades or modifications requested by the client post-installation.
- Additional vents, dampers, or ducting modifications, if required, will be quoted separately.
If no AIRosense site visit was conducted before providing a quotation, the Client acknowledges that the quotation was provided in good faith based on available information. The Client agrees not to hold AIRosense accountable for unforeseen challenges or adjustments that may arise during installation.
10. Client Responsibilities
- Clients must ensure clear access to installation areas, including ceiling voids and outdoor unit locations.
- Clients are responsible for promptly communicating any changes to installation requirements.
- By paying the deposit, Clients confirm their understanding and acceptance of these terms, including potential additional costs.
11. Final Inspection and Handover
- AIRosense will perform a final inspection to ensure the system functions correctly before handover.
- Any operational issues identified within 7 days of installation must be reported immediately for rectification.
12. Final Payment & Ownership of Equipment
- AIRosense retains full ownership of all installed air conditioning equipment until final payment is received.
- Failure to make full payment within 30 days of completion may result in legal action and removal of equipment at the client’s cost.
- Any disputes regarding additional costs must be raised in writing within 7 days of job completion.
- Failure to dispute within this period will be deemed as acceptance of the final invoice.
13. Dispute Resolution
- AIRosense and the Client agree to address disputes through direct communication and mutual agreement.
- If a resolution cannot be reached, mediation may be sought before legal action is taken.
- AIRosense reserves the right to seek legal recovery for unpaid balances or wrongful claims against the company.
